Terms of use

3.1 Eligibility

To use the Platform, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater. By creating an account, you represent that you meet these requirements.

3.2 Account Information

You agree to provide accurate, current, and complete information during the registration process and to maintain your information up to date. You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account.

3.3 Account Security

We strongly recommend activating two-factor authentication (2FA) to enhance your account security. You agree to promptly notify AvalonCert of any unauthorized use of your account or any other security breach.

4.1 Certificate Issuance

AvalonCert allows authorized Issuers to create and issue digital certificates recorded on the Polygon blockchain. Each issued certificate requires payment in AUTHAX tokens according to current fees.

4.2 Certificate Verification

The Platform offers tools to verify the authenticity of issued certificates, including validation by numeric ID, QR Code reading, and photo verification with AI technology.

4.3 Data Storage

Certificate metadata is stored on the Polygon blockchain. AvalonCert does not guarantee the perpetual retention of this data and recommends that users back up their certificates.

5.1 Permitted Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. The use of the Platform must comply with all applicable laws and regulations.

5.2 Use Restrictions

You agree not to:

• Violate any law, regulation, or third-party rights
• Issue false, misleading, or fraudulent certificates
• Attempt to access unauthorized parts of the Platform
• Use the Platform to distribute malware or conduct attacks
• Interfere with Platform integrity or data
• Extract data through scraping or automated methods
• Use for unfair competition or reverse engineering

5.3 Monitoring and Enforcement

AvalonCert reserves the right to monitor Platform use and take action against violations, including account suspension or termination.

6.1 AUTHAX Tokens

Issuing certificates requires AUTHAX tokens, available through Platform purchase options.

6.2 Fees and Costs

Polygon network gas fees in MATIC may apply and are determined by the network, not AvalonCert.

6.3 Refunds

Blockchain transactions are irreversible. No refunds for issued certificates or used tokens.

7.1 Platform Content

AvalonCert owns all intellectual property rights. No copying, modification, or distribution without authorization.

7.2 Feedback

Feedback becomes AvalonCert property for unrestricted use.

7.3 User Content

You retain ownership but grant AvalonCert a global license to use your content.

9.1 Platform Modifications

AvalonCert may modify or discontinue any aspect of the Platform at any time.

9.2 Service Interruptions

We strive for continuous availability but cannot guarantee uninterrupted access.

10.1 Termination by User

You may terminate your account at any time by contacting our support. Terminating your account does not affect the validity or accessibility of certificates already issued on the blockchain.

10.2 Termination by AvalonCert

AvalonCert may suspend or terminate your account at any time if you violate these Terms or if your use of the Platform creates risk for AvalonCert or other users.

15.1 Applicable Law

These Terms will be governed by the laws of Brazil without regard to conflict of law principles.

15.2 Dispute Resolution

Disputes will be resolved through binding arbitration, except small claims may be brought in court.

15.3 Entire Agreement

These Terms constitute the entire agreement between you and AvalonCert regarding the Platform.

15.4 Severability

If any provision is invalid, the remaining provisions will remain in effect.

15.5 Waiver

Failure to enforce any provision does not constitute a waiver.

15.6 Assignment

You may not assign these Terms without our consent. We may assign freely.
